To recover under the Jones Act, you must be considered a seaman under the Supreme Court’s definition. The Supreme Court uses the following criteria to determine whether or not someone is a seaman:

  • They’re assigned to work on a vessel that operates on a navigable waterway
  • Their duties contribute to the vessel’s function
  • They spend at least 30 percent of their time on the vessel

Keep in mind that “vessel” also has been defined by the Supreme Court. The Supreme Court defines a vessel as a watercraft that can be used as a means of transportation on the water. Examples include cruise ships, barges, container ships, and tugboats.

If you work on one of these and meet the other criteria above, you’re considered a seaman and are protected under the Jones Act.
