To recover under the Jones Act, you must be considered a seaman under the Supreme Court’s definition. The Supreme Court uses the following criteria to determine whether or not someone is a seaman:
Keep in mind that “vessel” also has been defined by the Supreme Court. The Supreme Court defines a vessel as a watercraft that can be used as a means of transportation on the water. Examples include cruise ships, barges, container ships, and tugboats.
